Change EU Responsible Person Without a Gap

If you need to change EU responsible person, the safe sequence is simple: get the new mandate accepted first, update product information second, and end the old mandate last. A switch usually fails not because of the signature, but because labels, listings, and documentation still point to the old setup while products are being offered to EU consumers.

The GPSR has applied since 13 December 2024 and replaced the old General Product Safety Directive. For non-EU sellers, the practical question is whether you already have a valid responsible economic operator in the EU for each product family, or whether you need a new one through our EU Responsible Person service.

When does it make sense to change EU responsible person, and when does it not?

A change makes sense when your current setup no longer supports actual selling into the EU-27 or Northern Ireland. It does not make sense to switch providers just to postpone missing documents, keep outdated labels in use, or duplicate a role that your EU importer or EU manufacturer already covers.

The first decision is not “Which provider is cheaper?” but “Who is already the responsible economic operator in the EU for this product family?” Under the GPSR, that role can already sit with an EU manufacturer, an importer, or an authorised representative with a written mandate. In some cases, a fulfilment service provider can also fill that function. If one of those operators already covers the products correctly, a separate Responsible Person service may be unnecessary.

ScenarioResultEvidence to confirm
Your EU importer already handles the responsible operator role for the product familyA separate provider may not be neededWritten allocation of roles, product-family scope, contact details used on labels and in listings
Your current provider no longer covers new product families or brandsA switch may make senseMandate scope, accepted product families, onboarding limits, current catalogue map
Your labels still show one operator, but your online listings show anotherFix the evidence before more EU offers go livePackaging artwork, listing screenshots, marketplace compliance fields
You want to switch because the technical file is incompleteSwitching alone does not solve the issueRisk assessment, test evidence, instructions, warnings, traceability file
Your current mandate ends this month, but the new one has not accepted the file yetDo not terminate yetWritten acceptance date from the new operator, overlap plan, stock split by date
You only sell B2B to EU professionals and never target consumersCheck scope carefully before switchingSales channel, offer language, destination countries, end-user profile

A sensible switch is therefore a scope and evidence project. Before you move anything, map product families, channels, and who currently covers each one. If you are unsure whether your documentation is even ready for review, start with the basics in our technical documentation guide and our guide on the difference between an EU Responsible Person and an authorised representative.

What is the right order to change EU responsible person?

The correct order is new mandate first, documentation handover second, label and listing updates third, old mandate termination fourth. An overlap period is usually the cleanest way to avoid a gap in which a product is offered to EU consumers but no EU-based operator is clearly in place.

Here is the sequence that reduces avoidable risk:

  1. Confirm who should cover the role going forward.
Check whether the future operator will be your importer, EU manufacturer, or a separate service provider.

  2. Get the new mandate accepted before ending the old one.
Acceptance should follow a real documentation review, not just an unsigned intention to onboard.

  3. Hand over the product file for the accepted product families.
The new operator needs enough evidence to take on the role credibly.

  4. Update labels, packaging artwork, inserts, and online offers.
The active operator details must match what appears on the product, its packaging or accompanying material, and what EU consumers see online.

  5. Terminate the old mandate with a defined date and defined scope.
The termination letter should identify product families and dates, not just say “all products”.

  6. Allocate old stock and future stock clearly.
Keep a dated record showing which units were covered by which operator and when.

The biggest mistake is reversing steps 2 and 4. Sellers often end the old mandate, then start redesigning packaging, then discover the new operator has not accepted the documentation. That creates the exact gap you wanted to avoid.

Which documents must be handed over before the new mandate is accepted?

The new operator should review the product file before acceptance, not after. At minimum, expect to hand over the technical documentation, risk assessment, product identity details, current label artwork, and any test evidence or declarations required under the product’s other applicable rules.

For many sellers, this is the slowest part of the switch. The issue is rarely one missing PDF. It is usually a mismatch between what the factory file says, what the label says, and what the marketplace listing says.

Record stock positionGoods in factory, in transit, at fulfilment, already sold into the EUSeller and logistics sideNo dated split between old-stock and new-stock coverage

A serious onboarding check should also ask whether there have been incidents, complaints, corrective actions, or previous marketplace removals. That is not a punishment step. It is part of understanding whether the product file supports the role in practice.

If your file is still being assembled, the faster route is to fix the core evidence first, then switch. A new name on the label does not repair a weak risk assessment.

How do labels, packaging, and marketplace listings need to be updated?

When you change provider, physical product information and online sales information must move together. If the product or packaging shows the old operator while the listing shows the new one, or the other way around, you create avoidable questions from marketplaces and authorities.

For future units, update:

Distance-sales offers aimed at EU consumers must show key seller and product information. In practice, that means the information in the online offer needs to be checked at the same time as the packaging file. If you sell on marketplaces, their structured compliance fields usually need the same update.

Marketplace listingSame operator details, warnings, and identifiersListing screenshot and field export if available
Listing imagesNo visible old operator details on current sales imagesDated image set
Reworked stockClear record of what was relabelled and whenRework log, photos, warehouse records

If you need a refresher on the information layer, see our labelling guide and our guide to required online sales information. The practical rule is simple: the product file, the label, and the online offer should all tell the same story.

Products already on the market: who is responsible after the switch?

Units already placed on the EU market do not automatically become “newly placed” just because you changed provider later. The key task is to keep a dated allocation showing which operator covered which product family, model, batch, shipment window, or stock pool.

This is where many sellers need a more careful handover. You may have:

Those categories should not be handled with guesswork. Your records should show:

  1. Which products were covered by the old mandate, and until when
  2. Which products are covered by the new mandate, and from when
  3. Which labels and listing versions were live during each period
  4. Who answers authority requests or incident questions for the older units

A written overlap period is often the cleanest solution. It gives you time to move documentation, approve new artwork, update online offers, and separate old stock from future stock. The end letter for the old mandate should refer to product families and dates. A vague termination message creates later confusion when an authority, a marketplace, or a customer asks about a specific unit.

One more point matters for online selling: an offer aimed at EU consumers counts as an EU-market offer. So if a listing still targets EU buyers while the old mandate has ended and the new one is not yet active, the risk starts before the first fresh shipment arrives.

How can Grüner Baum help with switching your EU Responsible Person provider?

Grüner Baum helps by checking the documentation before accepting the new mandate, then reviewing the visible evidence that must match that mandate. For a provider switch, that means the practical work is not just “issue a mandate”, but also confirm product-family scope, review the technical file, identify document gaps, and check initial labels and online listings for the accepted families.

On 17 September 2026, Grüner Baum publishes these annual plans on the pricing page:

Across those plans, the published scope includes:

Optional published services include a Formal Technical Documentation Audit & Written Gap Report for €129 per product family, 24-hour Priority Onboarding Review for €99 per company, Extended Authority Support for €125 per hour, and Extended Product Recall Management from €750 per project.

Grüner Baum does not certify products, does not replace the manufacturer’s legal responsibility, and does not guarantee marketplace approval. The manufacturer remains responsible for product safety and for the accuracy and completeness of the information provided. If you want Grüner Baum to review your switch plan, accepted product families, documentation set, and initial label and listing evidence, contact Grüner Baum here.

Frequently asked questions about switching your EU Responsible Person provider

Can I switch provider right before a sales launch?

Yes, but only if the new mandate is accepted before the product is offered to EU consumers and before the old one ends. The usual delay is missing evidence, not the signature itself.

Do I need to relabel all stock when I change provider?

Not always. The answer depends on where the stock is in the market, what details appear on the product or packaging, and who agreed to handle older units.

What documents will the new provider usually ask for?

Expect the product list, manufacturer details, technical documentation, risk assessment, relevant test evidence, instructions and warnings, current label artwork, listing links, and any sector-specific declaration that applies.

What if my EU importer already covers the responsible operator role?

Then you may not need a separate provider for those products. The important point is to confirm the role in writing for each product family and sales channel.

When should I terminate the old mandate?

Only after the new mandate is active and the visible product and listing information for future units has been updated. Use a defined end date and identify the product families covered by that end.

Do marketplace listings need to change at the same time as labels?

Yes. The online offer should match the active packaging and operator details, and marketplace compliance fields should be updated at the same time.
