The GPSR has no blanket exemption just because your business is small, a micro-enterprise or low-turnover. Your duties depend on whether you sell as a trader, on the product and the law that applies to it, and on your role for that product. A retailer is not automatically the manufacturer, and a private sale between consumers is not treated like a commercial offer.

## Does GPSR apply to a small business?

Business size alone does not decide the question. The European Commission's 2025 guidance says GPSR obligations are relevant to businesses of all sizes, including SMEs and micro-enterprises, while pure consumer-to-consumer transactions fall outside the Regulation.

| Situation | Likely result | Check before acting |
| --- | --- | --- |
| A trader offers a consumer product in the EU | GPSR generally applies unless an exclusion or more specific rule governs | Product, intended users, target countries, role and applicable sector law |
| A consumer occasionally sells a personal item to another consumer | Pure C2C transaction falls outside GPSR | Whether the seller is genuinely a consumer rather than a trader |
| The item is food, a medicinal product, a living plant, an antique or another product the GPSR excludes | GPSR may be excluded in whole or in part | Exact legal category and facts, not the seller's marketing label |
| Toy, electrical, cosmetic, PPE or another specifically regulated product | Product-specific EU law is central | Which GPSR duties still apply to risks or matters not covered by the specific regime |
| A compliant product was placed on the EU market before 13 December 2024 | Transitional treatment may apply | Evidence of the original placing on the market and compliance with the former rules |

Products placed on the market from **13 December 2024** and current offers should be assessed under the applicable GPSR framework. “Small,” “handmade,” “low volume” and “sold on a marketplace” are not standalone legal exclusions. The [handmade-product GPSR guide](https://eugpsr.de/en/blog/gpsr-handmade-sellers-guide) examines the adjacent hobby seller, artwork and antique questions.

## Which GPSR role does the small business hold?

The same company can hold different roles for different products. Its actions, not its preferred label, determine the role.

| Role for the product | Core small-business task | Important boundary |
| --- | --- | --- |
| Manufacturer, including a business selling under its own name or trademark | Ensure safety, perform the internal risk analysis, prepare and keep the technical documentation, identify the product and provide manufacturer information | Testing is selected according to the product, risks and applicable law; GPSR creates no universal certificate or test package |
| Importer established in the EU | Verify the non-EU manufacturer fulfilled the relevant duties, add importer details, preserve conformity and cooperate with authorities | The importer does not erase the manufacturer's obligations and may be the EU responsible person |
| Distributor or retailer | Verify required identifiers, operator details, instructions and warnings; preserve safety and act on known risk | A distributor is not automatically responsible for drafting the manufacturer's technical file |
| Authorised representative | Perform only the tasks covered by a suitable written mandate, including specified responsible-person tasks | An address listing alone does not create the mandate or transfer manufacturer responsibility |
| Fulfilment service provider | Can become the EU responsible person only where the earlier EU-established actors in the legal sequence do not exist | A marketplace or carrier is not automatically the responsible operator |

Start by writing down who manufactures, who first places the product on the EU market, who stores or distributes it and whose name or trademark appears on it. This prevents paying for the wrong service or preparing a manufacturer file for a business that is only a distributor.

## What is the lean GPSR checklist for a small business?

Compliance can be organised economically, but required work must be complete before a new product is placed on the market or offered online. Portfolio prioritisation is useful for deciding which products become sale-ready first; it is not permission to keep non-ready listings live.

| Order | Action | Practical evidence |
| --- | --- | --- |
| 1 | Classify the product, target users, countries and your economic-operator role | Scope note, applicable-law list and supply-chain map |
| 2 | Define each product or defensible product family | Photos, identifiers, bill of materials, design and manufacturing specifications |
| 3 | Collect existing supplier and design evidence | Declarations, relevant reports, standards, drawings and change records |
| 4 | Perform the risk analysis and fill evidence gaps | Hazard assessment, control rationale and targeted tests where appropriate |
| 5 | Finalise physical information and the required online-offer fields | Product ID, manufacturer and EU operator details, applicable warnings and listing screenshots |
| 6 | Keep the file current and run post-market controls | Complaints, incidents, corrective actions, recall contacts and version history |

Use the [risk assessment guide](https://eugpsr.de/en/risk-assessment), [technical documentation guide](https://eugpsr.de/en/documentation), [GPSR labelling guide](https://eugpsr.de/en/blog/gpsr-labelling-requirements) and [online-listing information guide](https://eugpsr.de/en/blog/gpsr-online-sales-required-info) for the detailed records.

## Can one file cover several products or SKUs?

Possibly. GPSR does not publish a numerical SKU allowance. A product-family approach is defensible only when the members share the safety-relevant characteristics that make one risk analysis and evidence set representative.

Check intended use and users; construction and safety-relevant design; components, material structure and suppliers; manufacturing method; hazards and risk controls; applicable standards or tests; instructions and warnings. Record variants and give every SKU a traceable identifier. A change in coating, battery, cord length, age grade, supplier, warning or intended use can require a separate assessment or updated evidence.

One label template can provide a controlled structure, but the exact product identifier, materials where regulated, warnings, languages and operator details must still be verified for each variant and target market.

## Does a small business need testing, CE marking or a GPSR certificate?

There is **no general GPSR certificate**, no universal laboratory test and no fixed page count that proves compliance. CE marking applies only where separate EU harmonisation legislation requires it for the exact product. Test reports belong in the technical file where the product's risks, a claim, a standard, a target-market rule or specific legislation makes them appropriate.

The economical route is to define the safety question first, reuse valid and representative evidence, and commission only the gap-closing test that answers that question. A supplier certificate with no product, material, batch, method or scope link is not enough by itself.

## What must a small online business show in the offer?

If you sell online or at a distance, the GPSR requires every offer to show clearly and visibly:

1. the manufacturer's name, registered trade name or trademark, postal address and electronic address;
2. when the manufacturer is outside the EU, the name, postal address and electronic address of the EU responsible person;
3. information that identifies the product, including its picture and type or another product identifier;
4. warnings or safety information required for the product in a language consumers can easily understand as determined by the target Member State.

A marketplace field helps display the information; completing it does not replace the risk analysis, technical file or correct physical product information.

## Does a non-EU small business need an EU Responsible Person?

A covered product needs an EU-established responsible economic operator, but a separate paid service is not automatic. An existing EU importer may already hold the role. Where the supply chain has no suitable EU manufacturer or importer, an authorised representative with an appropriate written mandate may be the right route; a fulfilment service provider is the final route in the statutory sequence.

The [EU Responsible Person guide](https://eugpsr.de/en/responsible-person) explains acceptance, mandate and exclusions. Never copy an operator's address onto a label before the exact manufacturer and product scope have been accepted in writing.

## What is a realistic small-business budget?

[Grüner Baum GmbH's GPSR compliance service](https://eugpsr.de/en/gpsr-compliance-services) offers an optional Formal Technical Documentation Audit & Written Gap Report from **€129 per product family**. If a written authorised-representative mandate is the right route for the responsible-person role, the Germany-based service starts at **€249 per year** for one accepted low-risk product family, which already includes the initial risk review and document-gap check.

Pricing does not turn the result into a certificate. Product classification, existing evidence, product-family equivalence and service acceptance must be checked first.

## Small-business GPSR questions

### Is there a GPSR exemption for small or micro businesses?

There is no blanket exemption based only on turnover, headcount or production volume. First check whether you sell as a trader, whether the item is a consumer product, whether it belongs to a product group the GPSR excludes and whether product-specific EU safety law governs the same risk.

### Does GPSR apply to a hobby seller or private sale?

A pure consumer-to-consumer transaction is outside GPSR. Calling an account private or describing an activity as a hobby is not decisive; repeated organised sales and the circumstances of the offer can show that the seller acts as a trader.

### Must every small business create a risk assessment and technical documentation?

The manufacturer must perform the internal risk analysis and prepare the technical documentation. An importer verifies the manufacturer's documentation and information, while a distributor performs its own verification duties. The answer therefore depends on the business's role for that product.

### Can one GPSR file cover several SKUs?

Potentially, but there is no official SKU limit. A shared product-family file needs defensible safety equivalence across intended use, users, safety-relevant design, components and materials, manufacturing method, hazards, controls, warnings and supporting evidence. Each SKU must remain identifiable.

### Does every non-EU small business need a separate Responsible Person service?

No. A covered product needs an EU-established responsible economic operator, but that role may be held by the EU manufacturer, importer, an authorised representative with a suitable written mandate or, where the preceding actors do not exist, a fulfilment service provider.
